Terms of Service (AGB)

By creating an account, accessing, or using the Fahrnex platform, mobile or web application, and any related services (together, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

If you are accessing or using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.

Fahrnex provides a cloud-based software-as-a-service (SaaS) platform for vehicle maintenance tracking, service reminders, expense tracking, document storage, service logs, and related fleet-management features, as described on the Fahrnex website and within the application.

The features available to you depend on the subscription plan associated with your account. Fahrnex may add, modify, or discontinue features of the Service from time to time.

To use most features of the Service, you must create an account. By creating an account, you agree to:

• Provide accurate, current, and complete information when creating and maintaining your account
• Keep your login credentials confidential and not share them with unauthorized parties
• Be responsible for all activity that occurs under your account
• Notify Fahrnex promptly if you become aware of any unauthorized access to or use of your account

Fahrnex is not liable for any loss arising from your failure to safeguard your account credentials.

Certain features of the Service are offered under paid subscription plans. By subscribing to a paid plan, you agree to pay the fees shown at checkout or in your order confirmation for the selected plan and billing cycle.

Subscription fees are billed in advance on a recurring basis (for example, monthly or annually) unless otherwise stated. Prices, applicable taxes, and billing cycles are shown during checkout and in your account billing settings.

Fahrnex may change subscription pricing for future billing periods. Where required by law, you will be given advance notice of price changes before they take effect.

You are responsible for:

• The accuracy of vehicle, maintenance, expense, and document data you enter into the Service
• Ensuring you have the right to upload and store any content, files, or documents you submit
• Using the Service only for lawful business or personal vehicle-management purposes
• Complying with all applicable laws and regulations in connection with your use of the Service

When using the Service, you must not:

• Using the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempting to gain unauthorized access to the Service, other accounts, or the underlying systems and networks
• Uploading viruses, malware, or other harmful code, or attempting to disrupt or overload the Service
• Reverse engineering, decompiling, or attempting to extract the source code of the Service, except where expressly permitted by applicable law
• Reselling, sublicensing, or making the Service available to third parties without Fahrnex's prior written agreement
• Uploading or submitting content that infringes the intellectual property or other rights of any third party

Fahrnex strives to maintain a reliable service but does not guarantee uninterrupted availability. Scheduled maintenance, updates, technical issues, third-party provider incidents, or unexpected outages may temporarily affect access to the Service.

Enterprise customers may receive separate availability commitments only if agreed in a separate written agreement.

The Service, including its software, design, branding, trademarks, and underlying technology, is owned by Fahrnex or its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.

You retain ownership of the data, documents, and other content you upload to the Service ("Customer Content"). You grant Fahrnex a limited license to host, store, process, and display your Customer Content solely as necessary to provide the Service to you.

Your use of the Service is also governed by the Fahrnex Privacy Policy, which explains how personal data is collected, used, and protected. By using the Service, you acknowledge that your personal data will be processed as described in the Privacy Policy.

Users may terminate their account at any time by contacting support or using available account settings where provided.

Fahrnex may suspend or terminate access if these Terms are violated, illegal activities occur, payment obligations are not fulfilled, or continued use may harm the Service, other users, or the security of the platform.

Fahrnex's liability for damages, on whatever legal basis, is unlimited in cases of intent or gross negligence, injury to life, body, or health, liability under the German Product Liability Act (Produkthaftungsgesetz), and any other liability that cannot be limited or excluded under mandatory law.

For damages caused by slight negligence, Fahrnex is liable only for the breach of a material contractual obligation (an obligation whose fulfillment is essential to the proper performance of the contract and on whose observance you may regularly rely), and in that case liability is limited to the foreseeable damage typical for contracts of this kind.

Except where liability is mandatory under the preceding paragraphs, Fahrnex is not liable for indirect damages, loss of profit, or loss of data.

Fahrnex provides the Service on an "as available" basis and warrants that it will materially conform to its documented functionality, but does not warrant that the Service will be uninterrupted, error-free, or compatible with every device or operating system.

You are responsible for maintaining independent backups of any critical vehicle, maintenance, or document data you store in the Service, to the extent permitted by applicable law. Statutory warranty rights of consumers under German law remain unaffected.

These Terms are governed by the laws of the Federal Republic of Germany.

Mandatory consumer protection laws applicable in the customer's country of residence remain unaffected where required by law.

Fahrnex may update these Terms from time to time to reflect changes to the Service, legal requirements, or business operations.

Material changes will be communicated through the website or by email where appropriate.

Continued use of the Service after the updated Terms become effective constitutes acceptance of the revised Terms.
